1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of all products, applications, websites, and services ("Services") provided by Saykudan LTD ("we", "us", "our").

By accessing or using our Services — including downloading one of our apps, visiting our website, or engaging us for custom development — you agree to be legally bound by these Terms and our Privacy Policy and Refund Policy.

If you do not agree to any part of these Terms, you must immediately stop using our Services.

Saykudan LTD is a software development company registered in England and Wales.

3. Our Products & Services

Saykudan LTD offers the following products and services, each subject to these Terms:

Each engagement may be subject to a separate Statement of Work or agreement, which takes precedence over these Terms where there is a conflict.

4. Eligibility & Accounts

To access certain features, you may need to create an account or submit a request. By doing so, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep any credentials confidential and secure
• Notify us immediately of any unauthorised access
• Take responsibility for all activities under your account

5. Licence to Use Our Apps

Subject to your compliance with these Terms, Saykudan LTD grants you a limited, non-exclusive, non-transferable, revocable licence to download and use our mobile applications for personal, non-commercial purposes.

This licence does not permit you to:

• Copy, modify, distribute, sell, or lease our applications
• Reverse engineer, decompile, or disassemble our applications
• Extract source code without a valid licence agreement
• Remove or alter any proprietary notices
• Use our apps to build a competing product or service
• Transfer the licence to any third party

6. Source Code Licensing

We offer source code licences for our published applications. These are governed by a separate Source Code Licence Agreement which you must sign before receiving any code.

7. Payments & Pricing

• In-App Purchases: Processed through Apple App Store or Google Play. Their respective terms apply.
• Source Code & Custom Projects: Pricing is quoted individually. A written quote or invoice will be issued before payment is due.
• Payment Methods: Bank transfer, PayPal, or other methods agreed in writing.
• Currency: All prices are in British Pounds Sterling (GBP) unless otherwise agreed.
• Late Payments: Interest charged at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts Act 1998.
• Taxes: Prices exclude VAT or other applicable taxes unless stated.

8. Intellectual Property

All intellectual property rights in our Services — including applications, website content, designs, logos, trademarks, software, and documentation — are owned by or licensed to Saykudan LTD.

Nothing in these Terms transfers ownership to you. Your use does not grant any IP rights except as expressly set out in a licence agreement.

• Trademarks: "Saykudan", "Sekai", "Mel Mods", "IPTV Core", and associated logos are our trademarks. You may not use them without written consent.
• Content: All content within our apps and website is proprietary. Reproduction without permission is prohibited.
• User Content: If you submit feedback or suggestions, you grant us a perpetual, royalty-free licence to use and incorporate it.
• Third-Party IP: Our apps may include third-party open-source libraries under their respective licences.

9. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt our Services
• Transmit viruses, malware, or malicious code
• Use automated means to scrape or collect data without consent
• Impersonate Saykudan LTD or any other user
• Engage in fraudulent or deceptive activity
• Circumvent security features of our Services
• Send unsolicited communications (spam)
• Distribute unlawful, defamatory, or infringing content
• Reverse engineer or extract source code without a valid licence
• Resell source code purchased from us

10. Disclaimers & Limitation of Liability

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law.

We expressly disclaim all warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That our Services will be uninterrupted, error-free, or free from harmful components
• The accuracy, completeness, or usefulness of any content

To the maximum extent permitted by law, Saykudan LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total aggregate liability shall not exceed the greater of the amount you paid us in the 12 months preceding the claim, or £100.

11. Termination & Governing Law

We may suspend or terminate your access at any time for breach of these Terms, fraudulent conduct, non-payment, or at our sole discretion.

Upon termination, all licences cease immediately and surviving provisions (including IP, Liability, and Governing Law sections) remain in effect.

We may update these Terms at any time. Changes take effect upon updating the "Last Updated" date. Continued use constitutes acceptance.
